Illinois' Gang Gun Law

New Illinois gang gun legislation signed by Governor Quinn on Dec. 3, 2009.

Below you will find Illinois Public Act 096-0829.  Touted as the new gang gun act this law mandates that a "gang member" in possession of a gun is sentenced to 3-10 years in prison and removes any ability for a sentence of probation to be handed down.  CJP questions the ability for the Chicago Police Department or the Cook County State's Attorney's Office to determine in a reliable and consistent fashion, free from corruption, who is and who is not a gang member.  You can read more about our thoughts on this law in our blog post here.
